These General Terms and Conditions of Sale (GTCS) apply to all products marketed by CARTALOTO. Any order implies the buyer's unreserved acceptance of these General Terms and Conditions of Sale (GTCS).
Art. 1 - ORDERS
Orders can be placed by telephone at (+33) 5 63 38 34 64, by post addressed to 6Bis Chemin de la Besse - Z.A.Fonlabour - 81000 Albi, France, by e-mail to contact@cartaloto.net or on our website: www.cartaloto.net. All orders are final and can only be cancelled or modified with our explicit permission. If the order is not executed in its entirety, any deposit or sum that was paid in advance is not refundable. We shall retain the sum as a form of damages. We can only be bound to an order after the explicit consent of the management. The data recorded by CARTALOTO serves as proof of all transactions carried out by CARTALOTO and their customers. Any order equal to or superior to €1500 must be paid by bank transfer or credit/debit card. For payments by cheque, the order will be processed on receipt of the cheque.
Art. 2 - PRICE
The prices of our products are displayed, including all taxes, excluding processing and shipping costs. In France, €5.90 incl. VAT for orders delivered to a pickup point (for parcels up to 20 kg), €9.90 incl. VAT for orders delivered to a home address and €30 incl. VAT for orders including bulky items such as electronic bingo machines, display boards, lottery wheels and Snacking material (Popcorn Machine; Paninis, etc.) Free shipping is applied in France for orders over €190 (including VAT) (except orders including bulky items). Prices are non-negotiable. Except under special conditions specific to the sale, the prices of the products sold are those shown in the price catalogue on the day of the order. They are expressed in legal currency including all taxes. Our quotations are valid for one month from the date shown on the quotation.
Art. 3 - PAYMENT
Payments for your orders can be made:
- by credit or debit card: Visa, Mastercard and other cards (on our website or by telephone at (+33) 5 63 38 34 64;
- by PayPal with the possibility of paying in 4 instalments without charge, subject to acceptance according to the supplier's conditions.
- by bank transfer (we can provide our bank details upon email request to contact@cartaloto.net);
- by cheque (must be issued by a bank domiciled in France).
Orders placed outside mainland France must be paid by credit/debit card or bank transfer. Payments by cheque are cashed as soon as they are received. If an order is subject to the payment of a deposit, it is validated only after receipt of the requested deposit. The balance shall be paid on the day of delivery. If payment is not received on the due date, if the reminder and formal notices are unsuccessful within 15 days of receipt, and if legal action is necessary to recover the sums due, a penalty of 15% of these sums due, with a minimum of €40, will be charged. Any delay in payment will result in the application of article L 441-10-I of the French Commercial Code and an indemnity calculated based on three times the legal interest rate in force and a fixed indemnity for collection costs of €40.
Art. 4 - DELIVERY TIMES AND TRANSPORT
All our articles are delivered in metropolitan France within 48-72 hours (excluding rigid card and very thick cardboard bingo tickets, personalised articles and lottery wheels). We deliver anywhere in Europe and worldwide under special delivery conditions subject to acceptance of a quote. Processing and transport costs are at the buyer's expense (not including free shipping for orders over €190. Parcels under 20 kg can be delivered to a pickup point. Heavy or bulky packages are delivered by a transporter and are subject to additional transport costs of up to €30. When an order includes items with different delivery times, the longest delivery date is confirmed. CARTALOTO reserves the right to split shipments, processing and transport costs are only charged on one shipment.
Concerning damaged or delayed deliveries, the purchaser must claim with the delivery company or postal service. In the event of a problem, the customer must make their claim with the transporter or delivery person at the time of delivery and inform our company within 48 hours by registered letter with acknowledgement of receipt.
Our delivery times are not guaranteed and cannot, in any case, be the subject of any compensation in the event of a delay.
4.1. Except for special conditions specific to the sale, delivery will be made to the place of delivery chosen by the purchaser at the time of order, within 2 to 3 days after the seller has received the order and payment.
4.2. If a delivery has not been made within seven days after the above time frame (except in cases of force majeure), the buyer is in their right to cancel the order by sending a registered letter with an acknowledgement of receipt.
4.3. From the moment of delivery, the risks of the products are transferred to the buyer.
Art. 5 - SATISFIED OR YOUR MONEY BACK - RIGHT TO CANCEL
Under the legal provisions in force, you have 14 days from receipt of your items to exercise your right to cancel, without having to justify the reason. Therefore, you can return the item(s) you dislike within the above-mentioned period. Only the price of the returned item(s) will be reimbursed, with the shipping and return costs remaining at your charge. The return of the item(s) must be made in their original condition and packaging so that they can be re-marketed. Under the regulations in force, the right to cancel cannot be exercised for products made to order, products personalised online or ones that have already been validated by the customer. The right to cancel can only be exercised by consumers or non-professionals (such as non-profit organisations).
Art. 6 - WARRANTY AND DURATION
Our guarantee is not subject to any form of compensation for operating loss and only applies after full payment has been made. Our guarantee does not cover any costs related to a defect in one of our articles. Our electrically powered equipment is guaranteed for 2 years, parts and labour (excluding consumables) subject to normal conditions of use. Transport costs to and from the site are at the customer's expense. Maintenance and repair of the product are free of charge.
The buyer has 2 years from the delivery of the goods to act. The buyer may choose between repairing or replacing the item, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code. They are not obligated to provide evidence of any lack of conformity within the 24 months after the goods were delivered.
The consumer may decide to implement the guarantee against hidden defects (French Civil Code article. 1641) and, in this case, choose to cancel the sale or receive a reduction in the price.
Art. 7 - WARRANTY EXCLUSIONS
Our guarantee does not cover damage caused by:
- Using the product for any purpose other than what is described in the user manual;
- The improper handling;
- Defective electrical network;
- The intervention or repair by a person not authorised by our company;
- The addition or use of subassemblies not provided for.
Art. 8 - PROTECTION OF PERSONAL DATA
Your personal information and data are necessary for the processing of your orders and may be transmitted to the companies that interact with you for the execution of these orders. This information and data are kept for security purposes, to enable us to improve our services and communications. Under the French Data Protection Act of 06.01.78, you have the right to access, rectify and delete your personal data, as well as the right to limit the processing and portability of your data. You also have the right to object on legitimate grounds to the processing of your personal data, as well as the right to object to the processing of your data for prospecting purposes. Art. 9 - LIMIT OF LIABILITY
The service provided by our company is limited to the design and supply of items required for a game. In no way can we be considered as the organiser of this game and our responsibility cannot be engaged in any way in the event of non-compliance with the legislation by the client. The purchase or use of our products implies that the purchaser or user is fully aware of the regulations and legislation in force governing the use of these products and in particular the law of 21 May 1836 concerning the prohibition of lotteries and that of 23 June 1989 concerning commercial lotteries, as well as all the decrees attached to these laws. For deliveries outside mainland France, our responsibility cannot be engaged in the event of non-compliance with the legislation in force in the country where the articles are delivered. It is the customer's responsibility to find out about the possibilities of importing or using the items he/she orders from their local authorities. We cannot be held responsible for any printing defects on the printed items. In the event that several winners appear at the same time, either by chance or because of identical printing on items, the true winner shall be determined by an additional draw or by any other means left to the customer's initiative. By using our products, the customer agrees to accept these limitations of liability.
Art. 10 - RESERVATION OF OWNERSHIP
The goods remain the exclusive property of our company until full payment of the price by the buyer (law n°80335 of 12.05.1980). In the event of resale, the full or partial price of the goods that have not been paid may be claimed.
Art. 11 - COMPETENT JURISDICTION
If the parties are unable to come to an amicable agreement, the Commercial Court in Albi has the right to settle any disputes or controversies.
Art. 12 - REFERENCE TO MEDIATION IN CASE OF DISPUTES
In the case of a dispute, if the buyer tries to settle the disagreement but fails, they have the right to ask a third-party mediator to intervene. These costs will be fully covered by the seller.
